Terms of sale:
- Supply Only This invoice is strictly for the “supply only” of the Goods listed. The price does not include installation, fitting, or commissioning. The Purchaser is solely responsible for engaging suitably qualified and insured marine professionals for all installation work. The Company accepts no liability for any loss or damage arising from or connected to incorrect installation performed by a third party.
- Custom-Made Goods & Refunds The Goods detailed herein are custom-manufactured and/or made to order for the Purchaser. In accordance with the ACL, we do not offer refunds for “change of mind,” incorrect choices, or for faults that are a result of circumstances outside of our control as outlined in Clause 3.
- Purchaser’s Responsibility & Limitation of Liability The Company guarantees its Goods against defects in materials and workmanship. However, the Company shall not be held liable for, and the Purchaser assumes full responsibility for, any costs, damages, or issues arising from: a) Incorrect Information: Inaccurate measurements, plans, or specifications provided to the Company by the Purchaser or their agents. Including drawings being signed off by the purchaser or their representative. b) Vessel Alterations: Any modification, repair, or alteration made to the vessel after the Company has recorded its final measurements. c) Vessel Suitability & Structural Integrity: The Purchaser is solely responsible for determining that the Goods are fit for the intended purpose on their vessel. This includes ensuring the vessel’s structure is sufficiently sound and/or reinforced to safely support the weight, load, and operational stress of the Goods. The Company is not a structural engineering firm and provides no warranty as to the suitability of the vessel itself.
By accepting this invoice and proceeding with an order, you confirm you have read, understood, and agree to these terms, and acknowledge they form part of our sales agreement.
